The Federal High Court in Abuja has declined an application that sought to prevent the Senator David Mark-led leadership of the African Democratic Congress, ADC, from operating, pending the substantive hearing of a suit challenging its legitimacy. Justice Emeka Nwite’s decision to refuse the ex-parte motion, filed by Mr. Nafiu-Bala Gombe, a former Deputy National Chairman of the ADC, stands contrary to some prevailing reports in a section of the media.

Justice Nwite’s ruling effectively denies the three specific prayers put forth in the ex-parte motion. This legal move, argued by Gombe’s lawyer, Michael Agber, aimed to secure an interim injunction against the current ADC leadership. The court’s refusal means that the Senator David Mark-led executive can continue its functions as the party’s recognized leadership while the broader legal dispute proceeds.
The court’s decision directly contradicts what has been circulating in certain media outlets, emphasizing the importance of awaiting official judicial pronouncements over speculative reporting. This distinction is critical for maintaining clarity and accuracy regarding the legal standing of political parties and their leadership structures.

Mr. Nafiu-Bala Gombe, identified as a former Deputy National Chairman of the ADC, has taken legal action to challenge the legitimacy of the current executive. His application sought to temporarily restrain the Mark-led faction, signaling an ongoing internal power struggle within the African Democratic Congress.
