The Supreme Court has overturned the “status quo ante bellum” directive earlier issued by the Court of Appeal in Abuja in the ongoing leadership tussle within the African Democratic Congress (ADC).
By this decision, the apex court effectively reinstates the executive committee led by David Mark, reversing its earlier delisting by the Independent National Electoral Commission (INEC).
In a unanimous ruling delivered on Thursday, a five-member panel of justices headed by Justice Mohammed Lawal Garba ruled that the order granted by the appellate court was unnecessary.
The court further held that the appeal on “jurisdiction” stemmed from an ex parte order directing parties to show cause, without first securing the leave of the appellate court.
