The United States Embassy in Nigeria has warned visa holders against misusing it by travelling to the United States for the primary purpose of giving birth, to enable their newborns to claim US citizenship.

The embassy gave the charge in an X post on Monday, July 28.

According to the post, consular officers would deny the visa application of any applicant deemed to have this intent.

“Using your visa to travel for the primary purpose of giving birth in the United States so that your child will have US citizenship is not permitted.

“Consular officers will deny your visa application if they have reason to believe this is your intent,” the post reads.

The warning comes amid the Donald Trump administration’s push to end birthright citizenship, which automatically grants citizenship to anyone born on US soil, regardless of their parents’ immigration status.

On his first day of his second term, Trump signed an Executive Order seeking to reinterpret the 14th Amendment, which guarantees birthright citizenship, arguing that it excludes children of undocumented immigrants or those on temporary visas.

Legal experts widely consider the move unconstitutional, citing over a century of Supreme Court precedent, including the 1898 Wong Kim Ark case, which affirmed birthright citizenship.

Multiple federal courts have issued nationwide injunctions blocking the order, and the issue is now headed to the Supreme Court.

The policy has sparked widespread debate, with opponents arguing it violates constitutional rights, while supporters claim it addresses immigration loopholes like birth tourism.
